PURPOSE
Use this agreement when the museum hires an individual as an independent contractor NOT as an employee. This contract protects the museum by clearly defining the relationship, addressing IP ownership, limiting liability, and protecting confidentiality.
CAUTION
Please be aware that there could be very high penalties if a worker is inappropriately classified by your organization as an Independent Contractor and not an employee. Whether or not the worker can legally be treated as an independent contractor (and not get any employee benefits), depends on many factors. If you are not sure about the designation of someone you are hiring, you should seek the advice of a labor attorney, licensed in your state.
WHAT’S INCLUDED
• The Independent Contractor Template includes the following essential provisions:
o Place holder for the business terms: payment, fee, schedule, services, etc.
o Termination Clause.
o Provisions addressing independent contractor status of worker.
o Confidentiality
o Choice of Law
o Work for Hire provision: giving the museum the rights in the Work Product (including copyrights).
o General provisions.
• Quick Reference Guide for the template, including instructions on how to use it and pro tips.
• Step-by-Step video demonstration on how to complete the Template.
• BONUS: Contract Review Checklist

PURPOSE
The Volunteer Liability Waiver is designed to help protect the Museum from legal claims arising out of a volunteer’s participation in Museum activities. By signing this Waiver, the volunteer acknowledges risks associated with volunteering and agrees not to hold the Museum legally responsible for injuries, illness, or property damage that may occur during volunteer service.
This Waiver should be signed in addition to a Volunteer Agreement, not as a substitute for it; especially when the volunteer is participating in inherently dangerous activity. Examples of such activities could be attending archaeological dig sites, moving big items, working with potentially toxic materials, operating machinery, conducting or observing science experiments, or working with animals (the list is not meant to be exhaustive).
